1. Agreement to These Terms

These Terms of Use govern your access to and use of Tyler TX French Drain, located at https://tylertxfrenchdrain.com (the "Site"), operated by J&N Peak LLC ("we", "us", "our"). By accessing the Site, submitting a form, or placing a call through a number displayed on the Site, you agree to these Terms. If you do not agree, do not use the Site.

2. Nature of This Service

This is an independent lead generation and referral service. It does not perform drainage or excavation work. All work is performed by independent local contractors who are solely responsible for their own licensing, insurance, workmanship and pricing.

To state this plainly and without ambiguity:

  • The Site is an independent lead generation and referral service. Its function is to connect homeowners with third party contractors.
  • We do not perform drainage, excavation, trenching, grading, landscaping or any other physical work of any kind, and we do not supervise, direct or control any party who does.
  • All work is performed by independent contractors. Those contractors are solely and exclusively responsible for their own licensing, registration, permitting, insurance, bonding, workmanship, materials, scheduling, safety practices, warranties and pricing.
  • We make no guarantee of work, of pricing, of availability, of scheduling, of contractor qualification, or of any outcome or result. No representation is made that any contractor will contact you, will accept your project, or will complete work to any particular standard.
  • Any contract for services is formed solely between you and the contractor. We are not a party to that contract and have no obligations under it.
  • Any dispute regarding work performed, quoted, promised or invoiced is between you and the contractor.

You are responsible for conducting your own due diligence on any contractor who contacts you, including independently verifying licensing and insurance where applicable, checking references, and reviewing any written agreement before signing it.

3. Informational Content Only

Content on the Site regarding soils, drainage behavior, installation methods and cost drivers is general information about conditions in the Tyler and Smith County area. It is not engineering advice, not a site specific recommendation, and not a substitute for an on-site evaluation by a qualified professional. Conditions vary from property to property, and nothing on the Site should be relied upon as a diagnosis of your particular property.

4. Acceptable Use

You agree that you will not:

The Site and its content, including text, layout, graphics and organization, are owned by J&N Peak LLC or its licensors and are protected by applicable intellectual property law. You may view and print content for your own personal, non commercial use.

6. Communications Consent

By submitting a form or calling a number displayed on the Site, you consent to be contacted about your inquiry by us and by one or more independent contractors, by telephone, text message or email at the contact details you provide, including where those details appear on a do not call registry. Consent to be contacted is not a condition of any purchase. Message and data rates may apply. Telephone calls may be routed through a call tracking number and may be recorded or monitored. 7. No Warranty

THE SITE AND ALL CONTENT, INFORMATION, REFERRALS AND SERVICES MADE AVAILABLE THROUGH IT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL J&N PEAK LLC, ITS MEMBERS, OFFICERS, EMPLOYEES OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, PROPERTY OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE OR ANY REFERRAL MADE THROUGH IT, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

WITHOUT LIMITING THE FOREGOING, WE ARE NOT LIABLE FOR ANY ACT, OMISSION, DELAY, DAMAGE, DEFECT, INJURY, PROPERTY DAMAGE, COST OVERRUN OR OTHER LOSS CAUSED BY ANY CONTRACTOR OR THIRD PARTY, INCLUDING ANY CONTRACTOR INTRODUCED TO YOU THROUGH THE SITE.

Some jurisdictions do not allow certain limitations of liability, so portions of this section may not apply to you. Where liability cannot be excluded, it is limited to the minimum extent permitted by law.

9. Indemnification

You agree to indemnify and hold harmless J&N Peak LLC and its members, officers, employees and agents from any claim, demand, loss, liability or expense, including reasonable attorneys' fees, arising out of your use of the Site, your violation of these Terms, or any dispute between you and a contractor.

The Site may contain links to third party websites or resources. Those links are provided for convenience only. We do not control, endorse, review or assume responsibility for the content, privacy practices, products or services of any third party site, and accessing them is at your own risk.

12. Governing Law

These Terms and any dispute arising out of or relating to them or to the Site are governed by the laws of the State of Texas, without regard to its conflict of law principles. Subject to Section 11, you agree that the exclusive venue for any action arising out of or relating to these Terms shall lie in the state or federal courts located in the State of Texas, and you consent to the personal jurisdiction of those courts.

13. Changes to These Terms

We may revise these Terms at any time by posting an updated version on this page and revising the Last updated date above. Your continued use of the Site after a revision constitutes acceptance of the revised Terms.

14. Severability and Entire Agreement

If any provision of these Terms is found unenforceable, that provision shall be limited or severed to the minimum extent necessary and the remaining provisions shall remain in full force. These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Site.
